[Solved] Divorced a month then the CMS comes, now a student

Hi all

Obviously the CMS wont talk to me about the issues.

My ex and I have only just divorced, I haven't even paid for it yet. I thought the arrangements for children was sorted after the court approved the divorce and that was all done and dusted.

But then about a month later she applied for Child Maintenance. I find this a bit much as was waiting for the divorce to finish so I could go to University. So now I am a student I am in dire straights. CMS dont want to listen when I say I am a full time student.

Hi There,

Child maintenance can be from the time you leave and doesn't have any bearing on the divorce unfortunately.

However, the amount they should calculate would be based on your wages, if you are a student and not working there shouldn't be anything to pay, i guess unless you are working part time.

What is the situation with your employment?

Hi there

I am claiming working tax credit and making websites in my free time, which is self employment, though I earn very little indeed. Last 3 weeks I earned nothing at all, sometimes I am lucky and get £50 or £70 a week, but not often. Trying to make a business in order to have some money while at university. Though I have a feeling I would be better off not doing that and living on a grant and loan.

Hi,

if you are earning money even a small amount then you will be liable to pay as far as I know, if you are registered as self employed then CMS are likely to set a base amount for you to pay initially until you can provide some proof of earnings.

Yes, I pay £7 a week now, flat rate.

My problem is when I goto University (though in truth I have financial problems already)

I don't know why they say you dont have to pay when you are a full time student, when most students have to work to pay for it.

I do find it a bit much that it wasnt means tested both ways as she doesn't need my money at all.

Unfortunately, it isn't about what she needs a lot of seperated families end up paying the resident parent money when they are much better off financially than the one paying.

As a full time student you are exempt from paying child maintenance. If they won't listen to you then go and see your MP.
