Hi,
Advice needed, I have been separated from my wife since October last year. Living in separate houses etc, she has recently taken out a personnel loan in her name. Am I responsible for any debt she has since she moved out of the martial home??
Just to add she also has a new friend!!! who she has also given £1000 to???
Thanks
Hi, Is the loan in just her name i.e. you have not any undertakings in the loan or signed any loan agreements? Is the loan a personal loan not secured against any joint assets?
If the answer is yet - you are more than likely not liable.
If you had a joint credit card or loan - then both are liable for the debt.
I would say not...unless you stood as guarantor. I assume she would have used her current address when applying for the loan and it is in her name only, so I can't see how you could be held responsible.
She has applied for the loan whilst living at another address, but has not changed her address with the bank i.e. my address. Does that make a difference as she moved to last october? I have not signed for anything or agreed to the loan, its a personal loan. Thanks
I cannot see that you are liable for anything. She cannot add to your liability without your consent - personal loans are exactly that - personal. If it was secured against property that was partly in your name, then you would have had to sign also. I would say you have nothing to worry about with the exception that if she gave your old address, then their may be a link to you with credit reference agencies, so it may be worth writing to them (main ones are experian, equifax, and I think CallCredit, but not sure about the last one) - I think the fee is about £2 to see your file - just to make sure it doesn't affect you.
Hi I agree, you wouldn't be liable for the debt as you haven't signed anything and the loan isn't in your name.

When you say she hasn't changed her address with your bank, does that mean that you have a joint account still? That could be tricky and if that's the case I would certainly advise you to get that put right.
Not necessary. I think your wife doesn't include your name when she get her loan and other debt.
