Hello you lot , my little man is almost 10 and stays with me under a court order for almost the same amount of time he stays with his mum. Half the hols as well. Now thats ace but as I am on the dole it gets a bit tight. I have asked the ex to give me some of the child benefit to help but that went down like a lead balloon. The CHB says that as she is claiming then I cant do nowt apart from taking the lovely woman to court and fighting it out there. Is that right? Come on chaps !!! Lend a guy some wisdom

That is right I'm afraid as your ex claims and she is classed as the resident perant, you aren't able to claim any.

Hi Darren, cheers for the quick reply. I think i should have added that we have a shared residence order... does that make a difference or am i flogging the proverbial ?
I'm afraid it doesn't make a difference, Child Benefit cannot be split between the two parents, and it is unlikely that the benefits agency would switch it from your ex to you.
As acdt says they won't split or change to you. It doesn't seem fair but it is how the system is at the moment, It isn't skewed against dads either, if the dad was the resident perant the mother wouldn't recieve a penny either.
