My wife and I have been separated for about 13 years. I pay maintenance via the csa. We both work, myself fulltime and she is a TA at a school. Yesterday she received a letter from the tax credit office claiming they have evidence that she is co habitating with someone. Giving her 14 days to make contact or credits would stop. She made contact yesterday evening. While trying to enquire what and where the evidence had come from, she was told to ignore any thoughts that it has come from a neighbour as they have obtained the information via the post office. They said it has been noticed that she get mail addressed to a male not registered at her address. When asked what prof they needed her to gather to confirm she was living only with the children, she was asked to provide a tenancy agreement.
My questions are;
Is it legal to monitor post?
How does a tenancy agreement prove anything?
If they can monitor post, then surely they can ask the council themselves for the information on the tenancy agreement.
I should add that she is not living with anyone other than the children, I spend most evenings and days off with the children and have done so for a while.

Wow I have never heard of tax credit office contacting the post office for information regarding a claimant. It all sounds a little big brother if true.
I would advise you to contact the Citizen's Advice Bureau for some advice regarding your questions. Their website is located here or you can call the helpline England call 03444 111 444 Wales call 03444 77 20 20 .
It all sounds a little odd. Let us know how you get on as it may help another site member with a similar problem.

I'd certainly be interested to know how they got this information - I wouldn't have thought they could get this without a court order at the least.
You're certain these letters are genuine I assume? And one or both of you have double-checked the return address/telephone numbers?
Just be certain it's not a phishing attempt. I was always taught to be cautious and it does sound a little odd π
