I'm separated and have 2 children. Long story short I put in a rival claim for child benefit and after a long time waiting have been successfully been awarded it for 1 of the children.
My child is disabled and my ex currently gets DLA and carers allowance in respect of him. Also child tax credit and housing benefit with a DLA premium.
My question is what now? Am I entitled to these things instead of her now that I am in receipt of child benefit for him?

I would imagine that as your son lives with his mum, she would still get the housing benifits as that is where he lives, and the same with tax credits.

That said I always thought unless you had residency you couldn't claim child benifits.

Me too - please would you be able to give more details as I would like to pursue a rival claim in the future.
In a nutshell, ex wife and I have 2 kids. We've been separated for 2.5 years. Kids have always spent Wed Sat and Sun with me (up until a few weeks ago when she started being arsy about Weds). This was an agreement between ourselves.
I put in a rival claim, supplied all the info the ask for like do they have stuff at mine, how often are they with me etc. Got supporting letter from kids school to say I'm involved (I'm more involved with school than ex wife tbh). Decision has been made we get for 1 child each now.
