One of my 3 children who used to live with his mum has moved in with myself and new partner he is 10 can I take child benefit and tax credits for him which is currently paid to his mother?Can I do this without hassle from his mother and at 10 is it ok for him as he has done just to come live with me by choice ?or have I got to legally do something or is it ok that he has decided to come to me?can his mother make my boy return to her against his wishes?

You can apply for tax credit and child benifits, the mother would have to confirm that he is now living with you though, what can happen is that when the mother realises that they will lose money they can try and bring the child back to live with them.

You could apply to the court for a residency order for your son, which would make this arrangement formal.
