[Solved] Charging order attached to house

My mate has just completed paying off debt to a Credit Card Company. They had a ccj awarded against him and then had a charging order attached to his house.

He has a letter confirming that the debt has been settled. How does he get the ccj closed off and the charging order removed from his house ?

Hi BP,

I will ask CCCS to pop by and see if they can advise you.

In the meantime maybe someone from the DadTalk community has experienced this situation.

Hi below par and thank you for your message

If your friend has repaid the amount they owe under the Charging Order, they can apply to the court for the order to be discharged. They should ask the court for a certificate of satisfaction and include evidence of payment. It is usual for creditors to inform the Land Registry that the interim and final charging order have been removed, but they should confirm this has been done by checking the Land registry themselves.

The CCJ will remain on his file for six years from the date of the judgement.
The court will notify Registry Trust Limited so that the register can be updated once it is fully repaid.

To obtain a certificate of satisfaction, your friend should send the court the case number; and a fee of £15 (cheque/postal order payable to HMCS).

I have attached a link to a booklet called ‘Credit Explained’ which gives further help and advice (page 15) http://www.ico.gov.uk/upload/documents/library/data_protection/practical_application/credit_explained_leaflet_2005.pdf

Hope this helps

Kind regards
CCCS Sue
