[Solved] Change to Spousal Maintenance

Hi, the Court Order which defines the spousal maintenance I pay to my ex did not include the usual clause on co-habitation for more than 3 months negating my payments to her.
My ex has co-habited with her now fiancée for 10 months and in December last year we agreed that I should amend the payments to her because of her co-habitation. We agreed to draft up a consent order which I did. However she has refused to sign the agreement and has now instructed her solicitor to apply for an enforcement order and have the payments re-instated.
I am intending to apply to the courts for a variation to the Court Order. Can any one give me some guidance as to the process?

Hi there

I'm afraid I know very little about the spousal maintenance side of things but I would have thought she would be given short shrift if she tries to get it reinstated now she's living with someone else!

Although we do have a number of Dads here that have gone through the divorce process, in the meantime I know of a good website for the divorce side of things where you may find the answers you seek, it's called Wikivorce.

There are also a number of solicitors that offer free initial consultations which might be useful to you.
