Hello
I am looking for some advice.
I live in Scotland as does my ex. I have an interim residency order for my 5 year old daughter. My ex has contact on a Wednesday and Sunday. The following week she has contact on a Wednesday and Friday to Sunday. There was a child welfare hearing and child welfare report carried out and as I say my daughter now resides with me and has done since March.
My ex refuses to pay child maintenance. I have contacted the CSA and they are investigating this matter. My ex pays £60 a month for sky but won't help with her daughter. Is there anything I can do about this?
I have paid for the court case privately and I am now in serious financial debt. My ex has legal aid.
My car recently broke down and I can't afford to repair it. My ex and I share transport. This was agreed at court. I am unable to help with pick up or drop offs now.
Will I get into trouble at court because of this? Surely the court will understand.
Any help is appreciated.
Many thanks
Hi There,
.
I would write to your ex, recorded delivery and inform her that in the interim until you can afford to get your car fixed that you won't be able to share the travel, it may also be worth sending a letter to the court as well so that there is also a record of this should things return to court if your ex goes that way.
,
I don't know how the judge would rule on this, but if you don't current;y have transport then it would be difficult to keep to this part of the order.

I would chase the CMS (I assume not CSA if it's recent) and find out when they are taking action - there will be arrears if the case is already open.
