Hi,
I have been divorced now nearly two years. I pay £393 a month for one child of the age of 5.
My ex work 3 days a week, lives in a 3 bedroomed house (for the two of them), and owns a car.
I am not paying the mortgage but I am still on it as the bank wont remove me as she can not get a mortgage on her own...this I am trying to change, but she is being stubborn.
I have a feeling my ex is upto something, if I remarry can she claim any of my new wife's income?
Thanks
Thanks for your reply, I thought this was the case, but wasnt sue if anything had been heard of before.
Hi Choppy
As Darren says above, she can't go after your wife's income, but if she is claiming child tax credits, you ex may be able to take that into account in your takehome pay.
Do you know if this is something that often happens??
Why would her income be classed as mine when it doesnt even come into my accounts?
Hi there.
From my experience it doesn't happen. It could and if your ex challenged then maybe CSA would look into it, But My current partner claims child benifit for my step son and this isn't looked at when my CSA contribution is calculated for my son.
Equally my step sons father has another child and the child benifit isn't used as part of his income either, the only deduction by Myself and my step sons father recieve is due to having another child living in the non residential house.
So for me as my step son lives with me and his mum I get a reduction in what I pay my sons mother, and as my step sons father has a baby in his home so does he. So if anything claiming child benifit for another child reduces not increases what you pay.
Hope this comes across clearer than it sounds Lol
Darren
It could be worth having a word with the citizens advice bureau regarding your name being on the mortgage as this will obviously have an affect on your ability to get another mortgage in the future.
