Now my ex has married her new partner (Dec 2011) can I force the sale of the house?
My ex was to be buying me out of the house we shared and still have a mortgage on. The mortgage was taken out in 2007, we spilt in Dec 2009. I stopped paying my share of the mortgage in May 2011 when I found out she had moved her new bloke in with her and my son.
She is not working, and although we entered in to a private agreement between her and I for her to buy me out last year this has now changed due to it not being her buying me out its her now husband buying my equity.
Without mentioning figures the house is currently valued around 5k less than it was when we bought in 2007 and I had agreed to sell my equity to her for 1/3 its value just to get rid of her hold over me. However that was last year and she’s still not paid up yet so I’ve asked for a revised offer which they are refusing.
So….can I force the sale of the house or them to buy me out? If so how?
I'm not 100% on this, I believe that either party can force sale, but to be honest, you need proper legal advice for this, and it's not an area the CCLC cover. I would be worth, in the first instance, having a word with the Citizens Advice Bureau.
