[Solved] Additional Paternity Leave Pay

OK here goes, I am currently employed by HM Prison Service I've recently had my forth child, this time around we decided to split the Maternity leave, so my wife took the first 20 weeks and me the latter end of it.

The prison service currently pays women on Maternity Leave for 26 weeks at full pay and then 13 weeks on SMP.

As I understand it when I started my Paternity Leave I took over all rights that were my wife's with regards to Maternity/Paternity, with that in mind should I still be eligible for 6 weeks at full pay (the remaining Prison Service Policy in regards to Maternity Pay of 26 weeks @ Full Pay) as if I was a female HMPS employee and then drop down onto SMP or do I forgo that right to the 6 weeks pay as I'm a father not a mother?

So far I have had it confirmed that's the case by two people in my HR but confirmed as wrong by another 2 people in my HR dept, as it stands at the moment it has had to be passed to a "senior" member of the joint Prison Service HR as no-one knows what I am supposed to be receiving full stop.....who should contact me with me an answer at some point in the future.

Any help would be greatly appreciated.

Hi and welcome

I'm afarid I'm not aware of anyone on here who has this specific knowledge - it's beyond the remit of the Chidlrens Legal Centre. I would suggest that you give the Citizen's Advice Bureau a call to see if they are able to help. Another possibility, are you in a union of any kind (is it the prison officers association?) - they may well have a legal person who can assist.
