looking for some honest advice please.
i have a 50.50 lives with order from the family court, it should have been more but that's another matter.
my ex is keeping all our childrens carers money as 1 of our children is disabled and she is also keeping all his dla money saying its a 50/50 lives with order not a 50/50 you should also have money for our child to help him order.
surly i care the same amount of time which i do so should be entitled to half, but she says its not fair on her as she wants the money, dwp have said they recommend 50/50 or 1 person claims until april and the next claim for a year and switch back, but she still refusing , what can i do please ?
You could split the child benefit, so each of you claim for one child (and if you have more than 2, perhaps you could claim for 2 and she could claim for one), that might even it out a bit and has the perfectly legal advantage that you are both claiming for a first child, so the rate is slightly higher.
DWP won't split individual payments between 2 people, so it's something you need to sort out yourselves I'm afraid, with regards to DLA etc
