Hi all.......frustrating isn't it? You do half the work, give half the care, have half the contact but get NO access to child-related benefits!
3 years post-separation and i'm financially destitute but the ex won't agree to giving me one of the child benefit books for our two children so that i can access child tax credit and housing benefit. I'd be willing to make an application to the courts if mediation fails. Does anyone know if a court can make an order regarding who child benefit is payable to? my ex and i have been sharing care and contact roughly 50:50 thus far but i cant afford to go on having my boys as much as they and i would like.Can court provide me with a solution going forward?

I'm pretty certain that the courts can't determine who the benefits go to, they can determine who has residence and that would determine who gets the benefits, but I would say that there is virtually no chance of them giving residence to you on financial grounds, that would only be likely to be awarded if the children were in physical or emotional danger where they are at the moment, which doesn't sound like the case. If you have the children for more than 52 nights per year, then you can reduce your maintenance payments, but that's about it I'm afraid.
