Hi all, i have posted numerous times about my situation but am here once again to seek some advice.
Basically i have two children, a two year old girl and a one year old boy. Me and my ex partner split up two years ago now, and throughout that whole relationship i was never aloud to take my beautiful children out for no reason whatsoever. Simply because she did not get along with my family. Throughout that relationship she made my life [censored]. Anyway. After support from family and friends i finally stood up to her and took her to mediation to finally gain proper access to my children without feeling the need to stay with this woman just to maintain our family. It was heartbreaking. I didn't see my children for two months whilst mediation was on going. I spent night and day researching and becoming knowledgeable with my rights and so forth. So in mediation i provided malicious texts that my ex had sent me over the past year. Texts for example like " i was just a sperm donor " and " my children are none of my business ", eventually after three meetings, i won. My ex agreed for me to have the kids on the a Sunday, including my parents having access. I was over the moon, we all were. Seeing my children after two months just made me complete. It brought tears to my eyes. But still. It took months for my children to even feel safe around me again. To feel comfortable around daddy which i know is to be expected of such young children. Things were fine for a few months between access arrangements. Until a few weeks ago. I haven't seen my children for three weeks as my ex partner wanted to have the children on the last two Sundays to take them on an Easter egg hunt. Now because i want my children to have a brilliant time and enjoy themselves, i civilly agreed to this. To later find out she was lying about this as their was no Easter egg hunt on whatsoever in my hometown as i looked into this. When i confronted her about this she said that it was Easter either way and she raises them so she will have them whenever she wants. And just today i have found out by a friend that my little girl has started nursery today. Without me even being told. When i confronted by ex she said and i quote " it's not the law to tell you everything, now leave me alone ". This has left me in tears. How could any mother say that to her children's father is beyond me. She refuses to involve me in their life since she started a new relationship. She refuses to tell me any information about them at all. She refuses to send me any photographs. I just don't know what to do anymore 🙁 I feel like my children are so use to this new man around all the time, they don't even feel as close as they did with me before. I am literally a broken man. My children are my life and i cannot even receive photos, or any sort of information about nursery or even a simple text to let me know how they are. Please can somebody give advice. Thank you so much.

Hi there

I'm sorry that mediation has only been partially effective....unfortunately what is agreed in mediation is not legally binding. Have you contacted the mediator and explained that she is reneging on her agreement and things have got to the point where she is refusing to share any information about the children with you.

As far as providing photos, I don't think she has to do this, it would be up to you to take these during your contact time.

Don't leave it too long, as you have already tried mediation, depending on how long ago this was, you should be entitled to progress this to court if necessary. There are new rules in place and mediation has become a compulsory first step. Residence and Contact Orders are now called Child Arrangement Orders.

Contact your mediator and see if he can get her back for some more sessions, and discuss with the mediator progressing it to court if necessary.
