Evening,
I have been paying child maintenance for several years now first just assessed by the CSA when i was working parttime and have paid everyweek ever since the assessment. Since then over a year ago i got a new full time job but continued paying the original assessment as i have never been reassessed.
When the changes happen from the csa to the cms if my ex starts up a new assessment with the cms or even the csa reassess before then would i have to back pay anything in either case or just start paying the new amount.
Ive heard allsorts of stories regarding this and just after firm advice.
Hi there,
You are supposed to inform them of any changes to your income and depending on what scheme you are under they may have wanted to increase the amount you pay, so they could look at back dating an increased amount from the point that you started full time. I'm surprised that you haven't had annual reviews which would have picked up the increase and recalculated....I can't be more definite, it's a possibility.
If you are under the old CSA system then I think a difference of 5% in your income would be enough, but under the new CMS system then your income would need to change by 25% either up or down for them to recalculate...at least that's my understanding.
If you have a look at the stickys at the top of the Child Maintenance section you'll find one called "How the CSA calculate payments" if you open the sticky you will see some links to information about both the old and new scheme which might explain your situation in more depth.
Yes, you are obliged to tell them any changes which affect the maintenance, so they could possibly get you for arrears (and a potential £1000 fine for failing to tell them, but I haven't heard and stories of this being imposed).
