[Solved] when is it fraud

please i need help an advice i have been making csa payments out of my my own esa benefit up until the 8/3/2017 having had a letter telling me things were changing and i had to talk to child maintenance team i rang them on the 14/2/2017 when i wasinformed as my son was in permanent foster care i no longer had to pay my son has been in foster care since 30/4/2014 is this fraud on the mothers side as she has knowingly kept her csa claim open with regard to my son even though she has had her parental responsabiltlty removed by the courts and social services where do i go from here to ensure my son gets the payments i have made to date and that his mother hands over the money i have paid

I think you could do with some legal advice on this one, I feel that it is fruad but I'm not sure how you could get that money back (or get it to your son) hopefully a solicitor would be able to advise you.

Unfortunately the money is most likely spent long ago. The only redress you may have would be to take it to small claim s court, it if she has no money it's highly likely you still wouldn't get it back. It would cost you to take the case to court and if found in your favour and she didn't pay, it would be back and forth to court to try and get paid.
