What can be deducted from child maintenance calculations.

Hi all, 

 

I am new to this page and looking for some advice please. 

 

I have received notification from my employer that child maintenance has been in touch and is requesting to attachment of earnings to be made.

The amount is far higher than it should be, also up to this point I was paying via bank transfer which I can prove. 

They calculated amount they wish to attach on to my earnings is £2344.36pm, after tax and ni I don't earn this never mind have anything left to survive.

This has all come about after a messy divorce which has left me loosing 65% of my army pension to save it going to court, I was advised with the new rules that I could possibly have lost 100% because I have the ability to work and create build a new one. (just for clarification the break was because she had cheated on me)

I am trying to find exactly can be used to reduce the amount that is paid, i.e. private pension, work pension, being in a IVA etc.

I have contested the amount and the information that she has supplied them including the amount of nights that they stay with me, also the distance for travel expenses.

Also I have sent off paperwork proving that I have been paying before this.

Sorry can you clarify, CMS want to deduct £2344.36 from your monthly wages?

Yes I have come across a dad where a judge ordered he give up his entire pension to ex, worth 250k!

With CMS can receive deductions if you support other children. Also theres a list of expenses you can claim:
