Hello. I am banging my head against a brick wall with this one and would welcome some advice.
CMS is using an old salary figure from 2022-23 for me this year following the annual review. Its higher by 5k compared to last (23-24) tax year. I asked for a Mandatory Reconsideration as the amount I can see on my HMRC account is accurate yet CMS continue to use the old figure. MR was rejected because they claim they pulled the figure from HMRC in July 24 and that is what they got.
HMRC dispute this and say their figure is correct and confirm CMS figure is incorrect. CMS say they will not change it now until next annual review in July 25, as it does not meet the 25% threshold. HMRC say it must have been an API technical issue why they got the wrong figure. My MP wrote to them, and they replied that they agree the figures do not match but their 'procedures' only allow them to pull HMRC data once a year. It clearly means I am now paying more than I should, despite a 5k salary drop. I know if I go to ICE they will say the same.
If I do wait until next year will they further reduce my payments to take into account the wrong figure this year? Or not?
Anyone with a similar experience trying to fight this 'procedure'?
If the CMS was a utility company and they billed you the wrong amount a simple upload of your meter reading would sort the issue out!

I am going through the exact same issue as we speak. It so frustrating.
What I intend to do is to appeal through to the Social Security and Child support tribunal.
I’ve been down this process before in the past it takes a whole year to go to court and have your case heard.
Download the form SSCS2 and complete and send it off.
You have one month from the date of receiving the mandatory reconsideration.

I’m in a similar position but my earnings reduced by nearly 50%! They’re still using earnings based on earnings from 2 years ago which they also based 9.5k of arrears on!
im currently awaiting a mandatory reconsideration but if they don’t recalculate the arrears based on the correct earnings which I’ve provided proof of I will go to a tribunal, to make matters worse I know my son (17) is no longer in full time education but she’s not informed HMRC, my current payment direct from earnings is £538 per month and I only gross about 2k!
it’s so stressful and takes so long to get anywhere I’m desperately trying to get proof he’s out of education and am reporting her weekly to HMRC for fraud it’s nice to know I’m not the only one the CMS are completely incompetent.
