My ex-wife has very recently instigated CSA action. After receiving a call from CSA I advised them that my children stay with me once a fortnight & some extra days sometimes. I was asked if these extra days would work out at them staying once a week. So I said yes. My ex wife disagreed with this & so contacted the CSA again & so they've increased the original payments. I've spoken to my ex & said that if she's going to be so difficult then I will stick to the children staying one night a fortnight & that's it. I won't have them say, on a Friday night when she & her new husband want to go away somewhere for the wkend, or into Mondays on a Bank Holiday. I want to spend more time with my children & I've asked that my CSA payments be reduced. If they are reduced does this mean that legally I can spend more time with them?
Please help.
Hi there.
CSA and contact are not linked in any way. What you pay has no bearing on contact, the only reason the CSA take it into account is to calculate the amount you should pay. They calculate that if you have the children more than 52 nights per year (1 night a week) then you get a reduction of 1/7th, if you have them for more than 104 nights per year (2 nights a week) the reduction is 2/7ths and so on...
Thanks. That's really helpful.
