I was on long term disability and my ex was getting £20.00 a month from my benefits. I feeling better managed to get a job in July 2013 my first wage was in August.
I am on the minimum wage and asked her if I could pay £80.00 a month but she wanted £100.00 a month. I had no problem giving her it and I have now been paying her it for 8 months now NEVER MISSING a payment..
This is a verbal agreement from my ex. and so she gave me her bank details to pay directly into her bank.
My son came to me saying he doesn't see enough of me, and asked if he could stay an extra night, so I went to the lawyer to make it official. At present I have him 4 nights a month shortly to be 6 nights a month.
My ex has now decided to contact CSA saying I am unreliable. " This is my punishment."
I have proven to CSA that this is not the case but they have decided to haunt me anyway.
I received a letter saying I have to pay her £38.00 a week and extra £14.00 a week of my minimum wage. They don't seem to have taken the discount off for my son staying overnight with me 4 nights a month, which will be changing to 6 nights a month shortly.
I myself working through the CSA calculator and based on my wages states I should be paying her £21.00 a week not the £38.00 they state and not the £25.00 I am paying her.
I have no problem giving her the £25.00 as agreed.
The fact that we had a verbal agreement, is it right that the CSA should step in at her say so, even though they were not involved for the 7 months of my working, and the fact she had no problem with me until I went to the lawyer.
Is it right that she can control the CSA by using them as a weapon against me.?
Give them a ring because when I first received my letter, I was shocked at the amount they wanted me to pay but its a letter that just takes your wages into account, you need to ring them and tell them about any shared care or pensions you have, they then take these off and recalculate the figure
Yes the CSA can step in if she asks them too, even if you've had a private agreement before
Does this mean even though CSA who agree I am up to date with no missed payments should still act on her say so. I was under the impression if I broke the verbal agreement and missed, then the CSA would have a right to step in.
I will phone the CSA later today and ask them to review my details and if their calculator is correct then I should be paying her £84.00 a month and not the £100.00 I have been paying. Once again I wish to state I have no problem in giving her the £100 but if it comes back it should be £84 then that's what she'll get
Yes, you are correct, either parent can ask the CSA (well, CMS now) to open a case. In fact, if your ex realises her mistake and backtracks, in your position, I would be inclined to open the case with the CMS anyway (and I think it has the advantage that only the parent who opens the case can close it) and then it's up to you what you do with the extra £16 per month - more money for a treat perhaps 🙂
