As a farther of two children who has just finished maintenance for both children who i have payed for fully to the old CSA so was shocked to receave mail from the CMS to inform me that i was in debt by £3775 as the mother had asked to claim this amount so on 31 10 2019 i contact the now CMS to explain that i had not only shared care i also had my youngest lived with me and the oldest lived with my parents but was informed that this amount was claimed for but the mother did not have to show proof but i did so as i had become disabled in this time it was going to be a hasell retreaving all proof i needed to get so on 6 11 2019 i called the cms and told them the situation they told me if i had a debt i would have to pay witch caused me untold stress but then to my shock on 7 11 2019 i got mail to say no further action needed so how do they deam this equal and would like to find out what legal action can i take as i now feel that she should have to pay back any benifets she has claimed for fraudulently from the goverment purse as it should not be allowed because the funds avalable are limeted and people cant continualy to take funds they arent entitalde to and get away with this crime as that is what it is a CRIME come on goverment get to grips please because after everything i was informed that the CMS had done my last assessment which i eas deemed to owe 000 why was i contacted in the begining and why did CMS let her if this information eas available to them ? And now am proven right that surely makes her a fraud ?
hi,
well the good thing is this got sorted out and you didnt have to pay the £3775 right?
as far as i know the mother can claim all benefits under the sun, and work. but father still has to pay child maintenance.
You can report her for fraud, but I doubt they will do too much to be honest. However, your priority is to get confirmation that the case is closed and that you owe nothing further.
