Tribunal and Overpayments to CMS

I am posting this on behalf of my partner.

Quick overview my partner has a child arrangement order in place as of September last year but there is still an outstanding issue regarding CMS payments.

His ex contacted the CMS before the CAO was in place and said that he does not have his daughter for any overnights (lies).

Now the CAO is in place we have uploaded the order to CMS website and we are waiting for the CMS to update his case. How long does this take roughly and have any of you received refunds? (he has been making overpayments for 7 months)

Also there was a tribunal in December which his legal representative said went in his (my partners favour) but we have not received any paperwork/result from the tribunal . For those that have been to a tribunal what, if any paperwork did you receive and what result?

hi,

I have no experience about tribunals. but as for sending court order to update shared care, they were very slow with me. said it takes 5 weeks. then after a complaint, they did it after 10 weeks! I think what they will do is only backdate the shared care from the date the court order was sent to them.

My ex was successful with her appeal to the tribunal, but CMS have not changed the payments.  I have asked the tribune to explain their reasons for their decision, but not heard anything even though the time limit for the tribune has passed.  Not too surprised as ex appealed in March 2021 and the hearing was not until March 2022!
