From 1994 to 2003 the NRP (my husband) paid his ex through the "old scheme" CSA. In 2003 she then closed her case and reapplied 13 weeks later, thus getting him migrated onto the then "new" 20% for two children scheme. He never actually stopped paying even when it was closed for the 13 weeks.
The case(s) finally closed in September 2011 when the youngest was 19 and no longer in education. At this point a full account breakdown was completed by a senior manager at the CSA and the NRP was found to have overpaid by about £1600 in total. This was all refunded to him.
Last week he received a letter from the Child Maintenance Service (who we had never heard of, never had any contact with, and who came into being after his case closed). The letter said he owes a few hundred pounds in arrears and they will be arranging enforcement action. It does not give any other information, dates or assessment amounts or anything. We had never heard from them prior to last week (5 years after the closure of the case) regarding these alleged arrears. I have called the CSA last week, they said it stated clearly on screen that the NRP case had closed in 2011 and that he was in credit. Since that call, just another threatening letter even though I have told them the NRP is terminally ill now. In 2011 the CSA even confirmed to my then MP that the NRP was in credit and would be refunded. I just don't understand how he can have a case with these people or where these alleged arrears come from
The 101 referance number they have quoted is different from his old CSA 101 number. The NI number is the correct one. I am wondering if they have in fact muddled him up with someone else who does owe money.
My husband is dying and they are doing this to us, when he was well in credit when his case closed. It is appalling. Any help really appreciated.

This is awful, I think your first action should be to contact CMS and ask them for a full break down of what they say he owes, they can't just give a figure and not show where it has come from.

If things check out and they haven't made a mistake, as in mixed people up, then I would ask your local MP for help again, get them to try and get some answers, I think as you have said CMS weren't even formed until after the case with CSA had been closed so I can't see where they have this amount from.

Do you know if the Child Support Service use the same case number as the CSA used, as the case number they are quoting is different to my husband's previous case numbers.
I have been contacted by a national newspaper today regarding this, but have said that I will call them back next week, as I am undecided whether to go ahead (knowing what papers are like). They will obviously wish to make political gain from such a story and I am somewhat against having our names aired in public. They will also name the PWC and the children (as they are over 21). so it is a big decision to make.

I think CMS use different case numbers to the CSA. I would contact your MP asap, this is something your husband does not need at this stage and it needs to be resolved quickly. If you do go to the papers, I would have thought you could insist that you will only speak to them on condition that they don't use your real names.
