[Solved] Sick pay whilst claiming EWS

Hi can someone advise in regards to what I pay whilst claiming EWS. I am long term sick & have to claim EWS now as am over the 31 weeks statutory sick pay. Does the reduced sick pay I will receive from my employer still be classed as income?

Will the calculation be my sick pay & my employment welfare support ? Or just the EWS payment?

I'm not sure about this, I would think that you might just pay the flat rate, assuming you are paying maintenance through CSA or CMS, but it's worth giving them a call to check this anyway.

Thank you for your post. If you have a case in place with either the Child Support Agency (CSA) or the Child Maintenance Service, you can find more detailed information on how the respective organisation calculates your child maintenance on Gov.uk at https://www.gov.uk/how-child-maintenance-is-worked-out. You may also wish to contact the organisation that is managing your child maintenance directly to discuss your query in more detail.

Where child maintenance has been set up privately via a family-based arrangement, both you and the other parents have the freedom to decide what factors will be included in your child maintenance calculation. Even though a family-based arrangement is not legally-binding and enforceable, both of you have the choice of whether to include financial and non-financial child maintenance into your arrangement.

If child maintenance has been set up via the courts (in the form of a Consent Order or Minute of Agreement), you will need to consult the terms and conditions that you and the other parent agreed in court to find out how your sickness and the benefits that you receive will affect how much child maintenance that you will have to pay.

To obtain impartial information about child maintenance, you may wish to get in contact with Child Maintenance Options. Their contact details can be found on their website at http://www.cmoptions.org.

You may be interested to know that the Department for Work and Pensions (DWP) have a new web application, 'Sorting out Separation'. Thanks for the replies.

I have a case through the CSA my reading of the regulations was that if I was claiming ESA then I would pay the flat rate and my sick pay was not taken into account.I have spoken to the agency and one representative stated that my sick pay was an income that had to be taken into account. However spoke to a friend who has been in that position and only payed the flat rate. Was hoping someone on here had experience of this.

Having had "problems" with the agency in the past, I try to contact them a little as possible. Any time I do my correct payment always gets recalculated & seems to go up!! But that's another story....
