[Solved] Shared parenting what maintenance should I be pay

Hello,

I am divorced and originally had a consent order setup at the time over 2 years ago where I had my children every other weekend paying over £500 /month maintenance based on CSA calc.

My children 16 and 17 are now spending (since September) every alternate week with me so 7 nights out of 14 and I tried to get my x wife to agree to not paying any maintenance as we were shared parenting. But no, she would not go for that even though I wanted to give more money to my children directly for up and coming University costs, and insisted on £380 based on CSA calc otherwise she was going to court ! She has the child benefit so therefore I have to pay it seems , although the court order has not changed to show this new model as she agreed to the week on week off model does she still have the legal right to request me to pay her ?

The original court order says that payment is due until secondary education has finished as in end of A levels..

Hi

Once the court order is a year old, then the CSA can act for you and override the court. Even though you share care equally, the calculation is not simply splitting costs equally, You still have to pay maintenance to your ex, the calculation being 20% of your takehome pay, divided by 2, less a further £14 per week (£7 for each child) - if we work on your original £500 per month, you would still be liable to pay about £190 per month to your ex.
