Hi Friends,

 

I have a usual case, of my 4 kids, one of them is disabled.  Due to that, the child cannot stay with me overnight, and it’s not logistically feasible.

that means that I pay 100% CMS for the child, which I’m happy to do.

On the other hand, the other children are with me all the time.  The prescribed amount according to the CMS is around 130 nights per year, but in reality it’s more like 170.  I plumbed it into the calculator and to my surprise it barely changed the calculation at all..  is this correct?!  

for some context, it reduced the £750/mo payment down to £710.  Does that sound correct?  Because if so, I won’t bother having the battle with my ex when she receives the letter!!

hi,

I suggest you double check your CMS account, by logging into online portal and then checking the section for shared care. It should tell you which band of shared care you are in:

 

If a child stays overnight with the paying parent for at least 52 nights a year, child maintenance will be reduced as shown in the table.

Number of nights of shared care each year (shared care bands) Cut to child maintenance (for each child with shared care)
A. 52 to  103 nights 1/7th
B. 104 to 155 nights 2/7ths
C. 156 to 174 nights 3/7ths
D. 175 nights or more

½ (50 per cent) plus an extra £7 a week

cut for each child in this band

if your not under the correct band, you should contact CMS and ask them to correct this.
