Hi hope you can help me on this, i see my son 50% of the time and have him overnight at mine. At the moment im also paying csa money to his mum !!!! surely this cant be right can it? ive been reading on here that if you have shared care then i dont have to pay her?? Can someone please help me.... many thanks
Hi there
If you are on the most current CMS scheme that is the case, but if you are still on an earlier scheme then it won't apply. The current scheme became effective from December 2012.
Of course if the mother tells the CMS that she has the child more, unless you have a court order that specifies 50/50 shared care, it might be difficult to prove.
i am on the new system but why am i still having to pay? ive called the csa and they have said i still have to pay,i dont understand?
Have a read through this thread

You do have to fight for it and it might help to get your MP involved if you are getting nowhere.
Best of luck
I thought this but when I checked I still had to pay even though I have my girl pretty much 50/50 I've always paid £65 a week to my ex agreed by our selves and I checked on the cms calculator and it still says I should pay £29 a week but I just pay the £65 as my ex struggles for money.
