[Solved] Self Employed But using my employed income

Hi

new to the site .. but struggling to get clarity on my legal position ... I have up until July 2017 always made payments for my son through the CSA. From July 2017 I became self-employed (through redundancy) and due to lack of earnings, I have not made payments ... I have always explained to my son's mother the situation and when I have money I buy clothes ... pay for school trips etc ... I have just had a letter from the CMS stating that their records indicate that I am being assessed on my employed salary that is starkly different to my current salary ( i do benefit from my wife who is a Dr and I as well as getting a business going look after our 2 children under 5 ) ... I have explained to the CMS that my next tax return is due Jan 2019 and they will see my REAL earnings ... they have stated that they will want money from 1st Jan 2019 ... a little stressed as I can't pay the stated figure and is not a true reflection of my income ... and the attitude from the CMS is that they will only listen to the HMRC ... advice?

I would certainly go back to them and state that you are no longer employed by the company they ware basing the salary on. You might be well advised to get some sort of interim accounts to them from your accountants, so they have a figure to work from.

In a similar situation they asked me to provide an estimate of profits on my first years trading and based the award on that. My accountant provided the figures.....
