Hi All,
My ex has recently contacted the Child Maintenance Service to get something official with regards to my payments for our 3 children, however....I have recently become self employed (January 8th 2018) but HMRC had me down as employed when the claim was originally put in (early January) even though I officially handed my notice in and left my employment on January 7th 2018.
The CMS therefore advised me to pay the amount of £54-00 to pay per week due to these HMRC figures.
The CMS are now asking for projected first year figures after I have advised them I am now self employed....but regardless of what this is...I am currently earning £0-00 so cannot possibly afford to pay a single penny at present time, so if my projected first year profit is £5k for example, this would mean that I would have to start paying her something now,but for the first few months at least I very much doubt that i'll be earning anything per week.
I won't have any clue what my actual profit is until the end of January 2019 when my first year accounts will be done by my accountant and issued to HMRC
What are my legal rights in this situation, as If i'm not earning a single penny over my outgoings how can I possibly afford to pay anything to anybody!!! If i'm not earning it then its just an impossibility.
anybody else in or have been in a similar situation that can advise me what to do??
Do I legally have to give the CMS any projected figures?? as thats all they are...projected....not actual!!!
Unfortunately I know very little about this side of things, hopefully someone will be along shortly that has some experience of your situation.

When I became self employed back in 2014 they set me up on a basic amount for 3 months and then once that time had past I had to submit almost like a mini tax return to them so that they could work out what I would have to pay.

They were very good and I found them easy to deal with, but I know many others haven't found it that easy.

They may also have changed the process since I became self employed.
.
If your projected profit is going to be zero for the 1st year then tell them that set out why it will be this way, your accountant may be able to help with this, I used 2 different accountants and both had experience of dealing with CMS/CSA
