I posted on here a few months ago about my ex claiming maintenance.

 

Essentially, she has lied about contact and stated that I only have my children for 2-3 nights a week (it is 50/50). I submitted a MR to the CMS which was inevitably rejected, despite having emails and text messages where my ex confirmed 50/50 contact.

 

I have submitted the appeal and the c100 court form. 

However, it has just occurred to me that I have ring doorbell footage, which shows myself and the children coming and going from my address for 16/31 days this past month alone!! Surely that is irrefutable evidence that what she is saying isn’t accurate? 

Has anyone ever had luck submitting CCTV / Ring doorbell footage. I really can’t see how they can argue with this?! It clearly shows the children on a daily basis coming and going from school to my address…

Hi,

you could ask CMS would doorbell images be enough evidence. They will probably reject and ask to see a court order. do you need any help with the court process? feel free to get in touch if you do. sending private message.

@dadmod2 I have submitted the court order, and the appeal, I’m awaiting dates for both. I’ve also submitted a claim for child benefit. I’m not longer paying as I was advised that if you refuse and they put you on collect and pay, you then have some chance of retrieving the money as CMS took it off you, rather than you paying it voluntarily. 

I just can’t understand the CMS - they are believing my ex off no evidence apart from, I’m assuming, child benefit. I don’t just want to submit doorbell images, I want to submit the entire video files. I don’t see how that could be argued with. They can’t claim it’s doctored or false or not showing what it shows. I’m going to call at 8am and discuss this with them. I’ll update here with what they say…
