Some advice please .
I am in dispute , as no doubt a lot are , with the CMS over payments . They have decided to levy 20% surcharge for payments dating back to 2014 . I have paid direct pay since 2014 and due to a disputed payment for September 2016 when my son didn't return to full time education they now want £3200 to cover the difference in amount paid directly and the amount which would have attracted 20% uplift .. Can they do this ?

Although I don't know a great deal about the financial side of things, I haven't heard them do this before, but nothing surprises me! As you made payments directly I can't see how they can levy the collect and pay charge, as they didn't collect.
If you can't seem to get through to them, I would put your concerns in writing and ask for all communication from them to be in writing, I would use the complaints procedure to escalate it, sometimes when you speak with them over the phone you can get mixed and often different responses. If you are still unhappy you can appeal and ask your MP to get involved.

The MP is already involved . But a damp squib . I have an appointment with NACSA coming up but wondered if any one else has come across the problem of retrospective surcharge . .
I have been battling the CMS for 4 years .. The stress is unreal and the rewards negligible .
Writing is ignored , phone calls you get shouted at and woe betide you if you read the law to the complaints department . . The phone goes dead.
Bullies I am afraid .. Just finished my latest 4 pager to them . It'll get scanned in at Gloucester and filed never to be read ... A copy will go the MP's office and they may chase it up in a week or two.
