Hi Sarah
My husband pays regular monthly maintenance for his son to his ex-wife according to an original court order dating back to 2002 where it states that payment must be made until his full time education finishes. If my stepson is currently at college (he is just about to turn 17), should my husband still be paying as he would prefer to give the money directly to his son now as his ex-wife uses it for her own means?

He needs to keep paying it to comply with the court order - he could go to the CSA but the rules are basically the same as is in the court order, as long as child benefit is paid, then he would need to keep paying. It might be worth checking the CSA calculator to see if he is paying too much.

So is full-time education deemed to be when my stepson leaves college, thus ending the 2002 court order?
