Hi All,
I am a NRP that has recently turned self-employed. I pay child maintenance for my son, who is 19, through a statutory child maintenance arrangement. My son has just left 6th form college as he found it wasn’t for him and has got a job working full-time as a Russian translator (he is bilingual ).
The CMS called me yesterday saying they need to review my weekly income as part of their periodic checks. I pointed out my son has left college and was working full-time, and that therefore I didn't think I needed to provide further information as child maintenance should no longer be paid. The response I got was that this was not consistent with their information and as far as CMS were concerned, child maintenance is still due and it requires his mother to contact them with an update, at which point they will close the case if she confirms my son is now working full-time.
Is this correct? That sounds as though until the CMS hear from my ex, I am still liable to pay! That seems ridiculous as my ex is extremely difficult (to put it politely 😉 ) and is never off her own back going to ask them to close the case.
Any advice appreciated.

Unfortunately, this is the case as long as she is claiming child benefit. I would ask the CMS to check this, but it's possible that she is claiming fraudulently, though if he has just left college, then CB and maintenance will still be payable for another couple of months.
