Hi all,
I need some answers please.
I will be the NRP in this case, and the RP has naturally opened a case for CM payments.
I stopped contributing CM 13 months ago because of the mothers consistently stubborn refusal to add my name to the birth cert or sign a PR agreement.
So.. I have insisted on a dna test.
Questions:
1. The CMA is insisting that I pay upfront for the test. Is there anyway that I can insist that the CMA pay for the test, and then charge me when the results come through?
2. Can I use the dna test results to get the courts to issue a Declaration Of Parentage that I am the farther?
3. If number 2 above is YES. Can I then use this declaration to get the birth certificate re-issued with my name listed on it as the father?
Can someone please, please help me?
Hi
I think you have to pay for the test and if it proves you aren't the father, the CSA/CMS refund you
I'm not sure about getting the birth certificate re issued as I've never come across this situation
You do realise that if she has opened a case with the CSA/CMS it starts from the date she called them, so you are getting into arrears at the moment
Many thanks for your response Huxley.
Yes. It dawned on me that I am getting into arrears.
With that in mind, I did call the CMA this morning to get them to send me a letter confirming my projected maintenance payment.
This way I can start paying ASAP before the arrears build up.
Never mind the point about the birth-cert . I am pretty sure that I can get this re-issued if I get a 'Declaration Of Parentage'.
The only outstanding question is: Can I use a DNA test result to get the court to issue an order confirming that I am the father?
Thanks actd. Yep.... To get PR.
Looks like that particular chapter of the war is coming to an end.
Next will be the battle for contact.
I have opened a Mediation Request. However I will insist on any agreement being confirmed by the courts.
