Hi I hope someone can assist. My husband has been paying CSA for 10 year to his two boys. Initially approx £600 per month whilst on minimum wage. Last October 2013 we were notified that his boys no longer stayed with their mother ( in kinship care) . However we found out that the kids had not been with mum since 2010. CSA stated to my husband that their mother was still claiming up until 2014. Initially not doing anything. My husband was then told he was due refund of 1500. His payments have since halved. My question is that surely he should not have been paying their mum 600 per month for 4 years when she did not have them. CSA. unwilling to address . We do see his boys and we don't mind paying the CSA but surely they should be refunding him those 4 years?? Any help would be appreciated. When you say the last 10 years, was this before or after 2003, because if it was after, I can't see how they can have got their calculation to £600 per month from someone on minimum wage. If I was your husband, I would want to see their calculations.
The problem with the CSA is that they only change their assessment from the date that they are notified of a change, so if the mother didn't inform them, then the CSA were acting correctly. However, there is a penalty for failing to notify the CSA, so the mother should be liable for this (haven't heard on here of the CSA every applying that though).
I would go and see your MP as a matter of urgency to get him to raise a complaint with the CSA - they can raise it at a higher priority than you are able to do and are more likely to get results. Take along typed notes with a summary in bullet point form for the MP to keep so that nothing is missed out.
