[Solved] Please help! CSA attachment to earnings repayment?

My husband has always paid CSA for his son through attachment to earnings. He pays an extra pound every week for this service, so that all paperwork etc is dealt with by his company.
In a nutshell they are now saying his contributions have not been enough and he now owes 5,000!
To his knowledge he was always paying his bit. Can they demand all this in one lump sum? Will they take my earnings into account? I earn more, will this matter?
We have a child of our own now and receive £80 a month child tax credit for her but nothing else.

We both want to lay what is fair, but this seems very unfair - will we be penalised for my earning more than the mother?

Please advise, I'm panicking we will have to pay an extortionate amount.

Hi

Firstly, your income isn't taken into account, only your husband's, so that isn't an issue. However, Child Tax Credit is (or should have been) included in the calculation, though it's difficult to see how such a large amount of arrears could be due purely to this missing from the calculation.

I would say that you need to ask the CSA for their calculation (and keep on at them repeatedly, as there have been plenty of stories of this not being given), and also contact your MP asap - they are able to raise a complaint with the CSA at a much higher priority than you can do - write all of the facts down and hand this to your MP so that nothing gets missed.

That actually rang yesterday (yes, Saturday?) . They actually admitted that they failed to infirm my husbands company of the need fir an increase - 7 years ago. He now has to pay more than double what he has in the last - amounting to £5,500 !

Again, we don't begrudge his son and his mother a Lenny, just don't see how that can get away with it, and expect us to handle the fallout.

Disgusting. Will deffo recommend he does as you say. We at least want it in writing that he wasn't at fault. Something like this could really break down relation in already difficult circumstances.

Sickening.

Definitely see your MP and get a complaint raised - since it's their fault, you want to make sure that you can make reasonable repayments instead of taking 40% of takehome pay.
