Hi, I am paying too much CSA due to my ex lying about my access and the CMS wont investigate they just take her word for it. my ex has told them i dont get over night access when infact i have them 108 over nights a year.. it works out i am paying £300 per month too much.
Is there anyone out there thats had tne same issues if so how did you deal with it.
They always take the resident parents word about overnights... but they should take the default position of accepting that the child stays one night a week, not ideal I know.
It's pretty difficult to prove without a court order that states how many overnights, but I recall someone actually taking photos of their child staying over, as photos taken on the phone are dated, also photos of them in the morning in Pjs, if you're travelling any distance you can also provide photos of them in the car with you, or with your location, such as your street name sign in the photo.
