[Solved] Paying parents outgoings

Hi can you please tell me if the Csa take into consideration the paying parents outgoings ie mortgage . Utility Bills . Vehicle for work . weekly fuel bill etc etc . Many thanks

Hi there

Unfortunately they don't take any of these things into account, CSA, or CMS as its called now, will only be interested in your gross weekly income so that they can calculate the amount they expect you to pay. For one child it is worked out as 12% of you gross salary, with reductions if you pay into a pension or the child stays overnight with you for 52 nights per year or more.

So your telling me that I could lose my mortgage not afford to keep my car on the road and therefore not be able to go to work and have a negative balance. That's just great. I have rights too we will see what the courts have to say about this I just can't afford 15% out my wages which is £75 a week for 1 child that rediculous .

After my outgoings I don't have £75 left out my wages so they will get what I can afford and that's that

It is now the Child Maintenance Service who deal with all new statutory child maintenance cases. The Child Maintenance Service are just one option available to set up maintenance payments. The others include the family-based arrangement and the Consent Order/ Minute of Agreement. The Department for Work and Pensions (DWP) have a web application, ‘Sorting out separation’. It aims to make it much easier for separating and separated parents (and childless couples) to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues. ...I'm sorry, if you read through other members situations you will find that there are many that struggle to pay.

It's 12%. of your gross income, not 15%. If you refuse to pay they can and will take the amount directly from your wages, which is harsh.

Your best bet is to try and negotiate with the mother directly and come to an agreement, this is called a family based arrangement.

As Mojo has said if you don't pay they have the authority to derectly collect the amount from your wage and as far as I am aware they then charge you more becuase of the admin ect.

I agree with Mojo, try and resolve this with your ex to see if you can arrange things privetely.

GTTS is correct - if you don't pay, then you go onto the "collect and pay" system, and they add an extra 20% onto your payments, which on the figure you have given, is an extra £15 per week (and this goes to the CMS, not to your ex) so it's definitely worth doing whatever you can to avoid this.

It's 15% not 12% Iv spoken to the Csa tossers and the have told me 15%

Ah ok....then you must be on the CSA2 scheme which was active from 2003 until 2012. They are in the process of moving cases over to the new scheme but it is a slow process.

I apologise, from your first post I got the impression that your case with the CSA was relatively new and so I applied the CSA3 criteria when answering you, which is a calculation of 12% of gross income, I should have asked you to clarify before answering.

The CSA2 scheme calculates an amount on net income at 15% for one child. Here's a link to their guidelines about the How maintenace is calculated under the CSA2 scheme
