can anyone explain to me how the Csa can still try and take maintainence off me . After I've signed a form agreeing that my ex wife's new husband can have parental responsibility and also agreeing to let my daughter change her surname to his ....

Hi there

Although you have agreed to the new husband having PR, that just means that he has it, but so do you. The only way to remove financial responsibility for a child i would be if her new husband adopted the child.

As it stands the CSA will still expect you to pay maintenance. You could ask your ex to play fair, as you have agreed to their requests over PR and the change of name, you could ask her to close the case with CSA, she can do this, all she has to say is that she wants to close the claim as you have reached a private agreement.

As explained previously, your ex-wife’s new husband would have to have legally adopted your child in order for you to no longer be liable to pay child maintenance. Giving parental responsibility and changing her surname does not change your liability.

The Child Support Agency (CSA) are just one available option for arranging maintenance payments. If you would like information about the other options and to receive a more personalised service, you can contact Child Maintenance Options directly, http://www.cmoptions.org.

The Department for Work and Pensions (DWP) have a web application, ‘Sorting out separation’. It aims to make it much easier for separating and separated parents (and childless couples) to find the support they need, when and where they need it, and encourages them to collaborate on a range of issues.
