I am a paying parent who's been a victim of CMS mismanagement (including taking more than a month to solve a simple dispute).
As I am sure I am following what the law says, I would like to know if CMS can recover overpayments to resident/receiving parents (in my case amounts to more than 2 months)?

If they are aware of overpayment then what they usually do is re-calculate your payment plan and take into account the over payments.

Thanks for replying. Is what you replied applicable if both child and receiving / resident parent moved abroad for indefinite time?
I think they will only recover monies if they are able. I know my ex overpaid me by one month (this was about 7 years ago, and I had custody of my children) and CMS were very clear that they would take me to court to recover that money if I didn't repay it. I'm not sure if they are so bothered these days.
