The CMS have closed my case based on the fact CB had stopped last year. The closure date (early 2018) means that I have overpaid to the tune of nearly £2500, The CMS helpfully ( grr) advised me the only way to recover the overpayments was to request this directly from the receiving parent, and if necessary take it to small claims. The receiving parent has acknowledged that she has been overpaid but stated she feels I should have carried on paying anyway outside of the CMS rules/decision . Does anyone have experience of recovering overpayments?
I know CMS chased me for a single payment that my ex paid to me - that was only a couple of years ago. If I didn't pay, they were prepared to take me to take legal action.
