[Solved] Overpaid but CMS saying no way of getting back?

Hi just wondered if anyone had experience of the following or know what I can do next.

My CMS cases closed in Feb this year, my case closing letter arrived recently and said the case was to of closed from 1st Dec 2016 but I wasnt informed until the end of Feb, this means that there a have been an overpayment of nearly £700.

I do not have contact with RP (long story but didn't know until child was 7 and only through CSA asking for payments) and I have no way of finding them. CMS are telling me they have no way of getting the extra money back from her for me.

They said I can try to claim through small claims court but that's more expens and again other than the RP name I have no other details, CMS admitted they knew early Jan but didn't tell me until my renewal date in Feb!

Hi there

It's terrible that they are so blasé with other people's money! They do have a complaints procedure, which out of principle, I think I would initiate if I were you. If you get no joy, you can always scalable it to your MP and ask if they can help.

I'd certainly go through the complaints procedure. The small claims procedure isn't expensive (worth speaking to the Citizens Advice Bureau), but I'd be inclined to consider suing CMS rather than the RP on the basis that they have been negligent. It's up to them to try to recover the money from the RP if they want to.
