Hi all
Iv just found out iv overpaid the ex by 6mths this has come through the cms I pay Standing order. Cms say it's up to the mother to tell the cms that my child is not in education but she hasn't. Can anyone tell me how I go about getting any money back. Cms say it's nothing they can do

Are you still expected to pay maintenance over the coming years? If so then CMS usually readjust your payment to take into account the over payment's.
@bill337 no cms closed the case text saying to cancel maintenance payment and case closed then sent me a letter dated 26th Feb 2024 saying as of September 4th 2023!!! I'm not to pay any more child maintenance!!!!! Which means iv overpaid by 6mths
@fran99 wow how disorganised of them. I suggest you take the complaints route and ask your MP to intervene.
Is it possible to make a claim through the small claims court? The mother has not told the cms that the child is no longer in education so its fraud. Not sure if it would win or even if the money would be repaid even if you did. There might also be other repercussions
