[Solved] On the Verge of Splitting Up - European Partner

Good Evening All,

I hope you can offer advice if possible

About 3 years ago, I fell in love with a Polish girl. We had 1.5 amazing years together - really amazing, she then got pregnant unexpectant,
it all seemed to change....in that time period, I changed my job from a contractor to permanent role with a company - with a view for security for my family.

Baby was born, first 6 months are ok, however the last year has been [censored] to be honest. I have seen a vicious and aggressive side of her - she has hit me a number of times
she drinks a few cans of beer, to help her sleep. She started smoking then stopped but now is addicted to nicotine tablets. We basically are together for the baby.

I went along thinking this will change it isn't, and more so their is no love their anymore. I feel like I am being used, despite her having a medical profession. her behaviour is constantly irrational,

THE LAST STRAW

I discovered she had applied to USA for a green card behind my back.

I guess I need to know my rights with my daughter if you can advise?

* Can she take my daughter to the USA without my permission?

* If she stays in the UK and we are to split - she seems to think I will be paying her parental contribution regardless if I see my daughter or not, she advised she will give me minimal access and when she advises it is ok.

What rights do I have?

* childcare - who responsibility is it to arrange childcare?

Please note we are not married.

I hope you can help, all i care about is seeing and being a part of princesses life.

It doesn't sound like you are in a great position, with your partners violence, I would report this to the police, have them make a record of it without any action being taken, you then have this on record should you need it in the future.

If you do split up, you will be liable to make payments through child maintenance, this would be 12% of your gross income, you can pay this directly to her or through CMS, if you look up CMS they have a calculator so you can check what you would be liable for.

Hi thanks, the money I will just have to handle its the

Access to my daughter ( her being difficult)

And the possibility she could just take off back to Poland with my daughter....

If you separate and believe she will take your daughter to Poland, you would need to apply to the court for an urgent Prohibited Steps Order and Child Arrangement Order. This would prevent her being able to leave and also lay out when you see your daughter.

Mediation is supposed to be mandatory before making a court application unless the issue is urgent.

You WILL be paying parental contributions whether you see the child or not, that argument is already lost in the UK im afraid.

You share parental responsibility if you are on the BC

Right now as noone has residency and no arrangements in place, childcare is equally your responsibility.

You may need to be applying to court if you have evidence shes about to leave the country with your child, I dont think its hague convention?
