[Solved] Non payment from ex since son move d in with me

Hi
This is all abit complex and I'm tearing my hair out.
I have 3 sons and have always paid maintenance on time since divorce. Eldest son came to live with me August 2014 and I claimed child maintenance from then. He was in full time education until February 2015 and then an approved apprenticeship directly after until November 2015. He did not work or claim any benefits until he turned 18 a month ago. Totally supported by bank of dad.
Getting to the point my ex has not paid a single penny. I have received numerous letters from the CSA with details of her liability. Many a confusing waste of paper.
I'd just like to ask what are my rights and should she have still paid for the time he was unemployed ? It seems to be a different set of rules when she is bleeding me dry. You're advice would be very much appreciated..

Hi there

Maintenance is payable whilst the child is in full time, non advanced education, which covers college and some approved apprenticeships. I doubt she would have been liable once this ended, although theres generally a continuation of payments for a few weeks after a child leaves education.

Has your ex been working all the time she was liable to make payments? If so you should write to the CSA formally and say that you have waited long enough for the arrears of payment due to you and unless you receive confirmation that this is going to be concluded with immediate effect you will be putting in a complaint about the service you have received and taking it to your MP and the Parliamentary Ombudsman, give them 21 days to respond and ask them to make all responses in writing. It might just gee them up, if not use the complaints procedure and see where it goes.

Best of luck
