Hi,

so I have always had a private arrangement, it’s never been an issue and I’ve always “paid my way”

my eldest daughter moved in with me 2 weeks ago… I haven’t made any changes to the private arrangement and have still paid the same amount…

yesterday I received a letter from CMS, stating that they now were looking at the case…

I paid £609 on the first of the month under the personal arrangement, the CMS are looking at starting a case against me from 8th March, they have already told me that they won’t take into consideration that I have already paid £609 on the 1st of the month and offset this… how?

secondly, they are basing my payments moving forward on my April 2022 year end which is £9000, more than my 2023 year end, and they won’t look at changing it until 2024!!!

surely they should be willing to accept 3 payslips to see I’m not earning that money! How can I be expected to pay something I’m not earning?

my first dealing with the CMS and can’t understand how biased to the recieving parent it is?

@bill337 this is regarding the two children that remain in her care.

I have put in a claim for the eldest that has come to live with me since receiving the letter yesterday

ok. I suggest you claim for child benefit for eldest child that move in with you. would take a while to transfer from your ex if she is claiming it.

with income amount, CMS use a 25% rule for people that have permanent PAYE jobs. so if the money your earning today is atleast 25% less than the amount you earned last tax year, you have to inform CMS and they should recalculate your maintenance and reduce it. if our income has not changed by 25% then they will not change anything.

CMS payments take effect from date your ex rang and opened a case. they are not bothered with what payments were made before this date usually.
