[Solved] need some advice

can some one help my son is was 16 in jan 2014, he was excluded from main line school oct 2012 he has been on some course funded by school but has been kicked off these, he done main exams in october 2013 with the local council.and is no longer doing any education at all he has been told no collage will take him on due to his behavior. When does my csa payments stop? ive also been told he does not live with his mother but she still claims his child benefit and other benefits been told he lives with his girl friend he could also be going to prison do i still pay csa when he is in prison? his mother will tell me nothing

Hi there

If he is not in education or at college then maintenance stops at 16...so you are not liable.

Give the CSA a call and speak to them, if the mother is still claiming child benefit you may have difficulty persuading them that he is no longer with his mother or in education and may tell you to contact the child benefit office. However the child benefit office will not discuss it with you.

See what the CSA say first, if you have any proof that he is no longer in education that would help your case.

NannyJane. It's really hard as I have proof my child has left education but its worthless to the CSA
The PWC is still claiming CB fraudently all I could do is report her for that

The system is awful! Surely they can check with the colleges but they are not allowed! Data protection

You can try your MP, some are really proactive and some don't want to know so its a suck it and see situation...fraud is a criminal offence so perhaps you could involve the police....but you're right the system is critically flawed! Ive known some dads report it to the benefit fraud hotline, but then not heard anything more and nothing happens.

Thank you for your post. I am William the Child Maintenance Options consultant. We are unable to comment on Child Support Agency (CSA) cases as we are a separate organisation and do not have access to your case information. However, I can provide some general information.

Under child support legislation, regular child maintenance payments must be made until a child is 16 years old, or 20 if they are in full-time, non-advanced education (A-level or equivalent), or for as long as Child Benefit is being paid. You can find more information on when child maintenance stops on Gov.uk at https://www.gov.uk/child-benefit-16-19. You can also find more information about Child Benefit on this site at https://www.gov.uk/child-benefit.

You may also wish to contact the CSA directly to discuss your query about child maintenance and your son potentially going to prison. You can find their contact details on any letters that you may have received, or by visiting Gov.uk at https://www.gov.uk/child-support-agency.
