[Solved] nasty ex

hi there everyone how yous all doing was looking for a bit adive of someone if possible i will give yous a quick run down on whats been happening with my ex i split up about two years ago with my ex partener who was heavy drinking and gambled away a lot money anyway cut a long story short i have two kids to her which i have 3 , 4 ,sometimes five days a week cause she cant handle or too busy partying i also pay her £30 a week but got home from work the other day and there it was the dreaded brown envelope {csa} my worry is that my ex denies this so she gets more money do i need to prove to csa that kids are at my house what happens in this situation would be very grateful if someone could help me out thanks a lot taffy

Just a thought, but have you thought about having the kids to live with you. I dont meaan that so you get out of paying, but you are saying she cant cope !!!! drinking, gambling !!!

Hi Taffy,

If you look at the bottom of the page you will see a link to Child Maintenance Options, on the right hand side you will find a maintenance calculator. All you do is answer a couple of questions and it will give you an estimate of what you should be paying. You could also google the CSA calculator which is probably more accurate, but have a wage slip ready as this will help wen you are filling in the questions.

The resident parent is the one that is in receipt of the child benefit, and even though you have the children mostly 50% of the time, you will still have to pay maintenance although the amount will be reduced....However the reduction only applies if you have them overnight. For instance, if they sleep at your house 3 nights a week then the CSA will be reduced by 3/7ths, 4 nights would be 4/7ths ...which is a reduction of about half. Of course the amount you pay will depend on the amount of wages you receive.

Women do lie to the CSA about the amount of nights the children spend away from their home and it is for financial gain...and basszebra is right about some mothers reducing contact with the father to increase the amount of CSA.

If you feel that your children are at risk as ak57 says, then you could apply for custody or Residency as its now called. This would mean you would have to go to court and prove that there is neglect, and then the court may rule that the children live with you, as in my sons case...he has custody of his 5yr old son. This can be very expensive, so a lot of fathers decide to represent themselves. At the top of the Legal Eagle section there are some stickys one is called Contact Order C100 Guide, thiis is the form you would fill in if you wanted to apply to court for Residency or for defined contact, and Representing yourself in Court which has lots of information about going to court without a solicitor.
