[Solved] My ex wife is lying about days i have my daughter

Hi, I am looking for some advice. My ex wife has approached the csa but has lied about the days i have her inorder to get a higher payment.

Just to clarify, i am a loving father who has been paying for clothes, clubs, and food for my daughter. But this was never made official, si.ilarly to the 2-3 days i have her per week.

Im sure im not the only person that has been through this and any advice would be greatly appreciated.

Hi there

To qualify for a reduction the child must spend overnights with you, when you say you have her 2-3 days a week does that include overnights?

When you pay maintenace through the CMS the amount they calculate is the only amount you are required to pay, so that if she has lied to get more money, you can always stop paying for all of the extras that you do now.

I understand that you wouldn't want your child to go without, but sometimes there's very little choice and if she's getting extra she should be in a better position to pay for more extras herself.

The contact rules are infuriating.
My 15yo daughter has recently increased her time with me to 50%. Using the CMS calculator I work it out to be about a £100 per month reduction in maintenance. However I cannot get a recalculation as her mother says the extra contact is not happening. I don’t want to stop the extra contact naturally, but it’s financially difficult as my extra costs are in excess of the potential reduction...and I’m not even getting that! (School bus alone is £75/month as I live slightly out of catchment).
CMS say she could deny the extra contact happens indefinitely.
Ex is now playing emotional blackmail telling our daughter she cannot afford to lose any income!
CMS suggest a new court order but solicitor says this will be difficult when child is mid to late teens as contact will become more unpredictable as she becomes more independent and has other commitments.
Again the apparently impartial CMS appears to be there to protect the recipient (even when her actions are nothing short of fraudulent!). No better than the CSA in my opinion.
